PUBLIC CONTRACT (OFFER)

For the provision of a flight with an instructor (paragliding) in Alanya, Turkey

This Agreement constitutes the Contractor's official and public offer to enter into an agreement for the provision of a flight with an instructor (paragliding service) offered by Alanya Paragliding on the website https://alanya-paragliding.com.

This Agreement is public, meaning that, in accordance with Article 633 of the Turkish Civil Code, its terms are the same for all Clients, without any preference being given to one Client over another.

By entering into this Agreement, the Client confirms their full agreement with its terms, booking, payment, cancellation, and rescheduling procedures, as well as the safety rules.

The Agreement is considered concluded upon confirmation of the booking (including verbal, written, or electronic confirmation) and payment of a deposit in the amount indicated on the website or agreed upon with the Contractor.

1. Definitions of Terms

1.1. Public Offer — the Contractor's public offer, addressed to an indefinite number of persons, to enter into an agreement for the provision of a paid flight with an instructor (paragliding) service.
1.2. Service — a flight with an instructor (paragliding), selected by the Client on the Contractor's website or ordered through other available communication channels.
1.3. Contractor's website — https://alanya-paragliding.com
1.4. Client — a legally competent individual over 18 years of age (or children with parental consent) or a legal entity that has placed an order for the service and agreed to the terms of the Agreement.
1.5. Contractor — Alanya Paragliding, a company operating under Turkish law and providing flight with an instructor (paragliding) service in Alanya in accordance with international safety and certification standards.

2. Subject of the Agreement

2.1. The Contractor undertakes to provide the Client with a flight with an instructor (paragliding), and the Client undertakes to pay for the service in accordance with the terms of this Agreement.

3. Booking, Payment, and Prices

3.1. Service bookings are made through the Contractor's website, messaging apps, at the office, or other communication channels.
3.2. To confirm the booking, the Client makes a deposit in the amount indicated on the website or agreed upon with the Contractor.
3.3. The remaining amount is paid on the day of service provision in cash at the office before the flight, or by another agreed upon method.
3.4. Service prices are set by the Contractor independently and are subject to unilateral change without prior notice to the Client, depending on market conditions. However, the price of a service fully paid by the Client prior to the change is not subject to revision.

4. Cancellation and Rescheduling Policy

4.1. If the Client cancels a reservation, the deposit paid is non-refundable and is considered compensation for reserving the Contractor's time and resources.
4.2. If the flight is impossible to conduct due to reasons beyond the Contractor's control (unfavorable weather conditions, flight zone closure, force majeure), the flight will be rescheduled to another date by mutual agreement.
4.3. If the Client is unable to reschedule the flight, the deposit is non-refundable.

5. Rights and Obligations of the Parties

The Contractor is obligated to:
• provide the service on the agreed date and time, subject to safe weather conditions;
• provide a qualified instructor and the necessary equipment;
• inform the Client of safety regulations.

The Client is obligated to:
• arrive at the specified place and time;
• follow the instructor's instructions;
• notify of any medical contraindications.

6. Liability

6.1. The Contractor shall not be liable for failure to provide the service due to reasons within the Client's control (lateness, no-show, on-site cancellation).
6.2. The Client is responsible for complying with safety rules and the instructor's instructions.

7. Other Terms

7.1. All disputes shall be resolved through negotiation; if this is not possible, they shall be resolved in the Turkish courts.
7.2. This Agreement shall be governed by Turkish law.
7.3. The Contractor reserves the right to amend this offer without prior notice by publishing a new version on the website.
